There is a warning message before you open that gallery. www.foto-shooting.es is not responsible for opening that gallery, because the visitor was clearly informed before entering.
Exclusion of liability
We make every effort to keep the information on our Web site current, but accept no liability whatsoever for the content provided. We are not obligated to monitor third party information provided or stored on our Web site. However, we shall promptly remove any content upon becoming aware that it violates the law. Our liability in such an instance shall commence at the time we become aware of the respective violation. Our site contains links to third-party Websites. We have no influence whatsoever on the information on these Websites and accept no guaranty for its correctness. The content of such third-party sites is the responsibility of the respective owners/providers. At the time third-party Websites were linked to ours, we found NO GROUNDS WHATSOEVER of any likely contravention of the law. We shall promptly delete a link upon becoming aware that it violates the law.
1. General Terms
These terms in English language are translated from German. Therefore the German wording of the “AGB” (allgemeine Geschaeftsbedingungen) applies. These terms and conditions are valid for all jobs executed by the photographer. They are accepted by the client if not rejected immediately or changed in a written contract. “Photos” is the general description of all products of the photographer. No matter in which format or media they were created. This accounts for both, photos and videos.
The usage of the “Photos” described in the contract between client and photographer apply – any other usage is forbidden and will be punishable by law. The copyright of the “Photos” remains with the photographer if not mentioned otherwise in writing. The “Photos” created by the photographer are for private use of the client only. It is forbidden to sell the pictures unless permitted in writing by the photographer.
Remuneration for the “Photos” will be calculated on a “per hour” basis, “per day” basis or an amount agreed by the client and the photographer. 50% of the remuneration amount are to be pre-paid, the remaining 50% at the delivery of the “Photos” at the latest. Claims regarding picture-style or creativity of the photographer are excluded. Should the client wish to alter the previously agreed services during or after their creation/execution, additional occurring cost are to his account.
4. Ownership / Custodianship
Media created for the client remain in the photographer’s ownership until full payment for the services provided. The photographer digitally safe-keeps the media with care. The photographer is entitled but not obliged, to delete the media after a period of one year after the end of the service. Lost media can be requested by the client within this one year period. Re-creation of a CD/DVD with the media and shipping are to the account of the client.
The client is responsible for covering his liability as the photographer cannot be made liable for any health issues or other negative incidents occurring during the photo shoot except for intention damages or gross negligence by the photographer.
The client is liable for submittals and resulting copyright damages from that. The liability of the client encompasses as well the extra booking of third parties where written consent of the third parties appearing on the “Photos” is mandatory.
In case of event photography booking it is the responsibility of the client to inform persons that could appear on the “Photos” at the event beforehand and obtain their permission. The photographer takes on no responsibility in such a case. Resulting damages from third parties are to the account of the client.
The photographer is only liable for not mainting deadlines by intention or gross negligence.
Client information necessary for the services can be saved by the photographer. The photographer commits to treat all client information with the upmost confidentiality.
7. Image retouch
The retouch of the “Photos” by the client himself or the distribution of them requires a written permission of the photographer. The permission and range/type of “Photo” retouch requires a separate written contract.
The photographer has permission to delegate the retouch to a third party. If the client requests a specific third party, that cost will be to his account, no matter if the photographer contracts that third party for him or he contracts that third party himself.
It is the obligation of the client to obtain permission from the creator of a “Photo” should the photographer retouch foreign “Photos”.
8. Salvatorius clause
Should one or more of these terms and conditions (AGB) be legally void, they will not be entirely void. The void terms will be replaced by legal terms, which come closest to these terms. Changes in terms and conditions do not need to be announced.
